In Spain the different Statutes of Autonomy are undergoing substantial revision. That revision is being made with repeated invocations of the federal model, without noticing that it would never permit a process in which the federated pieces did not form a whole with the federal pieces. There must first exist an overall agreement on such fundamental questions as competencies, financing, institutional relations, etc. Lacking such an agreement at the political level, the situation must be corrected at the legal level. In (...) Germany, which has been the great model for Spanish constitutional design, the notion of constitutional loyalty has been a key element, developed, among others, by the Federal Constitutional Court. The Spanish Constitutional Court, however, until now has not gone into the sacramental foundation of the principle, there where it hides its ultimate authority and, therefore, it finds itself detained for the moment at the starting point of a road it has yet to cover. Because loyalty is the hinge of the state, the lubrication that “serves to facilitate movement”, it reconciles the pieces of the decentralised federal system (federal, regional, or whatever you want to call it). Loyalty acts as the backdrop, which is what in the theatre strictly speaking closes the scene, giving sense to the whole set. (shrink)

Este artículo aborda el papel que juega la “admiración” en la traducción heideggeriana de tres pasajes de la Metafísica de Aristóteles. Con base en el volumen 62 de la Gesamtausgabe, se muestra que la “admiración” se relaciona con tres temas fundamentales, a saber: el mundo, la vida y la comprensión. En primer lugar, analizo el tema del mundo compartido y del mundo circundante. En segundo lugar, describo el tema de la vida, la cual es interpretada como “premura insoslayable” y “clara (...) permanencia tranquila”. En tercer lugar, desarrollo el tema de la comprensión en tres fases: “epistémica”, “propia” y “visible”. Estos temas serán retomados en trabajos ulteriores como Ser y tiempo. Por tal motivo, las lecciones de 1922 son valiosas para conocer el itinerario filosófico de Heidegger en los años veinte. Finalmente, se intenta mostrar que la triple traducción del vocablo griego θαυμάζειν realizada por Heidegger, obedece a un criterio específico de interpretación fenomenológica acorde a los temas mencionados. O positivismo jurídico é predominantemente ensinado e aplicado há décadas por profissionais da área jurídica brasileira, geralmente com referência à construção teórica de Hans Kelsen (1881-1973), deixando à margem muitos outros estudos que oferecem importantes formulações e conceitos para a compreensão do Direito contemporâneo. Este artigo se junta a algumas poucas pesquisas sobre outros referenciais teóricos acerca do positivismo jurídico, analisando a regra de reconhecimento no pensamento teórico de Herbert Hart (1907-1992), apresentando-a como incremento e superação da teoria imperativista de (...) John Austin (1790-1859). A partir de pesquisa bibliográfica, mostramos que, em Hart, a regra de reconhecimento (modalidade de regra secundária) apresenta-se indispensável para a certeza necessária ao Direito, bem como para aferir a validade do sistema jurídico. Luego, se explora el tránsito hacia su desilusión en la clave de la influencia de Schopenhauer sobre Wagner. Finalmente, el ensayo remata en la crítica madura de Nietzsche sobre Wagner, donde se advierten los prolegómenos decimonónicos (...) de la transformación general del arte en espectáculo en el sentido contemporáneo. In discussing the works of 16th-century theorists Francisco de Vitoria and Alberico Gentili, this article examines how two different conceptions of a global legal community affect the legal character of the international order and the obligatory force of international law. For Vitoria the legal bindingness of ius gentium necessarily presupposes an integrated character of the global commonwealth that leads him to as it were ascribe legal personality to the global community as a whole. But then its legal status and (...) its consequences have to be clarified. For Gentili on the other hand, sovereign states in their plurality are the pinnacle of the legal order(s). His model of a globally valid ius gentium then oscillates between being analogous to private law, depending on individual acceptance by states and being natural law, appearing in a certain sense as a form rather of morality than of law. What modal relation must a fact bear to a belief in order for this belief to constitute knowledge of that fact? Externalists have proposed various answers, including some that combine externalism with contextualism. We shall find that various forms of externalism share a modal conception of “sensitivity” open to serious objections. Fortunately, the undeniable intuitive attractiveness of this conception can be explained through an easily confused but far preferable notion of “safety.” The denouement of our reflections, finally, will be to (...) show how replacing sensitivity with safety makes it possible to defend plain Moorean common sense against the spurious advantages over it claimed by skeptical, tracking, relevant-alternative, and contextualist accounts. The topic is experimental philosophy as a naturalistic movement, and its bearing on the value of intuitions in philosophy. This paper explores first how the movement might bear on philosophy more generally, and how it might amount to something novel and promising. Then it turns to one accomplishment repeatedly claimed for it already: namely, the discrediting of armchair intuitions as used in philosophy.

In what way is knowledge better than merely true belief? That is a problem posed in Plato’s Meno. A belief that falls short of knowledge seems thereby inferior. It is better to know than to get it wrong, of course, and also better than to get it right by luck rather than competence. But how can that be so, if a true belief will provide the same benefits? In order to get to Larissa you do not need to know the (...) way. A true belief will get you there just as well. Is it really always better to know the answer to a question than to get it right by luck? In part i we ponder: Is knowledge always better at least in epistemic respects? The affirmative answer is subject to doubts deriving from a conception of belief as sufficient confidence, but is defensible against such doubts. In our search for the special value of knowledge, we then explore in part ii the relation between knowledge and proper action. Part iii goes on to consider how the value of knowledge intuition acquires further interest through its equivalence with the view of knowledge as a norm of assertion. Finally, part iv steps back to examine what we might mean in saying that to know is always, necessarily better than to get it right by luck while really in ignorance. In order to defend our value-of-knowledge intuition we need first to understand it more clearly. Part iv offers an explanation. (shrink)

A discussion of George Bealer's conception and defense of rational intuition as a basis of philosophical knowledge, under three main heads: a) the phenomenology of intellectual intuition; b) the status of such intuition as a basic source of evidence, and the explanation of what gives it that status; and c) the defense of intuition against those who would reject it and exclude it on principle from the set of valid sources of evidence.

The contribution of Jesuits to the different fields of knowledge, including philosophy, is historically well known. In fact, since the foundation of the Society of Jesus, in the 16th century, Jesuits from different generations and cultures have taken part in the philosophical debates of their time and their different contexts. Since the foundation of the Society of Jesus, in 1540, the Jesuits, individually and as a body, have engaged in a fruitful dialogue between the Christian tradition and different dimensions of (...) human culture. During almost five centuries, numerous Jesuits taught philosophy in academic institutions all over the world. Some of them have their names recorded in the history of philosophy. Of course, the majority of them is not anymore remembered, despite their valuable contribution to the development of the Jesuit intellectual tradition up to our times. In fact, as an heir of the Roman College, the first academic institution founded by the Society of Jesus, in 1551, the Pontifical Gregorian University, in Rome, is a witness to this tradition, which has been kept alive thanks to the discrete work of both Jesuits and lay intellectuals. Known as the University of the Nations, this institution corroborates not only the capacity of the Jesuit tradition to put faith in dialogue with reason, but also the option to take the concrete reality of each human culture and its historical context as its point of departure. The Jesuits’ willingness to engage in dialogue with different intellectual perspectives is underpinned by one of the most defining traits of the Jesuit charism, namely, the conviction that God can be found and served in all things. Accordingly, Jesuits have adopted, from the beginning, an amenable stance towards the world with its different cultures and intellectual trends. As such, Jesuits have, since the beginning, inhabited the frontiers of human thought. According to the contemporary philosopher Paul Gilbert, SJ, within the institutions under the leadership of the Society of Jesus, it was always possible to maintain an equilibrium between two principles: “intellectual unity” and “openness to the world.” Without detriment to the Jesuit identity, the companions of Ignatius have been willing to dwell in the various dimensions of human reality, in their multiplicity and plurality. Either in the renewal of Aristotle’s and Aquinas’ metaphysics, or in the dialogue with modern philosophers such as Descartes, Kant, or Hegel, and even in the inculturation in non-European contexts, the Jesuits have been able to preserve the Christian tradition through an original development of human culture in all its richness and diversity. With respect to the last century, it has to be acknowledged that a significant number of Jesuits made significant contributions, with recognized competence, to philosophy. Certainly, the 20th century was particularly complex in many respects. It would be enough to recall that this period, which brought with it unprecedented social, scientific, and technological developments, was also the stage for the two World Wars. With the emergence or consolidation of philosophical currents such as Marxism, Phenomenology, Existentialism, Structuralism, and Post-Modernism, the past century was, without any doubt, fascinating from the intellectual point of view. Jesuits such as Karl Rahner, Frederick Copleston, Bernard Lonergan, William Norris Clarke, John F. Kavanaugh, Teilhard de Chardin, Gaston Fessard, Jean Daniélou, Henri de Lubac, Michel de Certeau, Xavier Tilliette, Paul Valadier, Paweł Siwek, Ignacio Ellacuría, Francisco Taborda, Henrique de Lima Vaz and, in the Portuguese context, Diamantino Martins or Júlio Fragata, among many others, were able to engage different philosophical currents, problems and controversies of their times. Faithful to their long tradition of being present in the frontiers of thought, those Jesuits have engaged in a fruitful dialogue with these intellectual trends, offering relevant contributions to different ongoing debates. Within this context, the present volume recalls and discusses the philosophical contribution of some of the most prominent Jesuit protagonists of the intellectual interchange that took place in the 20th century. This volume also intends to celebrate the 75th anniversary of the Revista Portuguesa de Filosofia, which happens just before the inauguration of the Ignatian Year. Decreed by Father Arturo Sosa, the Superior General of the Society of Jesus, this celebratory Year will start on May 20, 2021, precisely 500 years after Ignatius of Loyola, the founder of the Jesuit Order, was wounded at the battle of Pamplona. We are happy that this volume could bring together outstanding specialists in the thought of some of the most prominent Jesuits philosophers of the last century, namely Paul Valadier, Paul Gilbert, Józef Bremer, Jacek Poznański, Alexander Maar, Patrick H. Byrne, M. Ross Romero, Carlos Alvarez, Hélio Pereira Lima, José Gama, Domingos Terra, Gabriel Flynn, Marie-Gabrielle Lemaire, José Sols Lucia, Lorena Zuchel Lovera, Pedro Pablo Achondo Moya, Enzo Solari, Massimo Borghesi, Mendo Castro Henriques, João Barbosa, and Dominique Lambert. In addition, in the celebration of the 100th anniversary of Júlio Fragata’s birth, Maria Teresa Fragata presents a memory of his life and thought. We hope that this volume may be useful to all those interested in the Jesuit philosophical tradition. Hopefully, it will stimulate scholars to pursue a fruitful and creative dialogue with contemporary philosophy, in the footsteps of the Jesuit philosophers featured here. A telic virtue epistemology was presupposed in our treatment of insight and understanding. What follows will lay out the main elements of that telic theory and explore how it provides an epistemology of suspension.

Relocating Kripke's puzzle about belief, this paper investigates i) in what the puzzle consists, exactly; ii) the method used in its construction; and iii) relations between meaning and rationality. Essential to Kripke's puzzle is a normative notion of contradictory belief. Different positions about the meaning of names yield different views of what constitutes the attribution of contradictory belief; and Kripke's puzzle unwittingly _imports a Millian assumption. Accordingly, the puzzle about belief is not independent of positions about the meaning of names.

The core niche for language use is in verbal interaction, involving the rapid exchange of turns at talking. This paper reviews the extensive literature about this system, adding new statistical analyses of behavioral data where they have been missing, demonstrating that turn-taking has the systematic properties originally noted by Sacks et al. (1974 ; hereafter SSJ). This system poses some significant puzzles for current theories of language processing: the gaps between turns are short (of the order of 200 ms), but (...) the latencies involved in language production are much longer (over 600 ms). This seems to imply that participants in conversation must predict (or ‘project’ as SSJ have it) the end of the current speaker’s turn in order to prepare their response in advance. This in turn implies some overlap between production and comprehension despite their use of common processing resources. Collecting together what is known behaviorally and experimentally about the system, the space for systematic explanations of language processing for conversation can be significantly narrowed, and we sketch some first model of the mental processes involved for the participant preparing to speak next. Stephen Grimm finds me inclined to bifurcate epistemic assessment into higher and lower orders while showing awareness of this only in recent writings. Two untoward consequences allegedly follow: (a) my rejection of Virtue Reliabilism, and (b) my knowledge-based account of the value attaching to our knowledge on the higher level. By contrast, Grimm considers Virtue Reliabilism a perfectly adequate account of knowledge, while the higher epistemic state he believes to be, rather, understanding, which he takes to be quite distinct from (...) knowledge. Once knowledge and understanding are seen to be distinct, finally, this will help us to avoid the two untoward consequences. I am grateful for these interesting points, and would like to respond briefly in what follows. (shrink)

_Dialectic and Dialogue_ seeks to define the method and the aims of Plato's dialectic in both the "inconclusive" dialogues and the dialogues that describe and practice a method of hypothesis. Departing from most treatments of Plato, Gonzalez argues that the philosophical knowledge at which dialectic aims is nonpropositional, practical, and reflexive. The result is a reassessment of how Plato understood the nature of philosophy.

There is a controversy in contemporary philosophy over the question whether or not knowledge must have a foundation. On one side are the foundationalists, who do accept the metaphor and find the foundation in sensory experience or the like. The coherentists, on the other side, reject the foundations metaphor and consider our body of knowledge a coherent whole floating free of any foundations. This controversy grew rapidly with the rise of idealism many years ago, and it is prominent today not (...) only in epistemology proper but also in philosophy of science and even in ethics. The discussion of this issue has been lamentably hampered by confusion and misunderstanding, and in this neither side is wholly innocent. The reflections that follow are not meant to settle the controversy, but only to help us understand it more clearly. (shrink)

Contemporary philosophy’s antipathy to intuition can come to seem baffling. There is inadequate reason to move away from the intuitively attractive view that we have a faculty of intuition, in many ways akin to our faculties of perception and memory and introspection, that gives us reason for belief, and with it, often enough, gives us knowledge. The purpose here is to consider whether scepticism about intuition is more reasonable than a corresponding scepticism about other epistemic faculties. I am sceptical that (...) it is. (shrink)

Life may turn sour and, in extremis, not worth living. On occasion it may be best, moreover, to lay down one's life for a greater cause. None of this is any news, debatable though it may remain, in general or case by case. Now comes the news that life does not matter in the way we had thought. No resurgence of existentialism, nor tidings from some ancient religion or some new cult, the news derives from the most sober and probing (...) philosophical argument (the extraor- dinary Parfit, 1984, Part III), and takes more precisely the following form: Even though life L is optimal (in all dimensions), and even though if it were extended L would continue to be optimal, it does not follow that it is best to extend it, even for the subject whose life L is. What is the argument? Section II will defend a certain view of the nature of persons and personal identity, and Section III will then argue for the Paradox on that basis, and reflect on its philosophical implications and on the options it presents. Polyfacetic epistemology would answer the skeptic, provide how-to-think manuals, explain how we know, and more. To some it is the project of assuring oneself, of validating one's knowledge or supposed knowledge, turning it into real and assured knowledge, thus defeating the skeptic. To others it is a set of rules or instructions, a guide to the perplexed, a manual for conducting the intellect. To others yet it is a meta-discipline, but one whose purpose is not nearly so much guidance as (...) understanding, understanding of what gives us the knowledge we do have, of what factors serve to justify so many of our beliefs well enough to make them knowledge. What follows is epistemology as understanding, an attempt to understand the relation between epistemic coherence and intellectual virtue at the foundation of epistemology: between the comprehensive coherence prized in the thirst for understanding and the "reliability" that makes a faculty or procedure intellectually virtuous. (Nietzsche, Beyond Good andEvil, IV, 146) One ofthe most satisfying parts ofan extended engagement with the mimetic theory is the bird's-eye view of history that it affords one—that magnificently coherent panorama which stretches from proto-hominids through (...) the Passion to post-culture and the Apocalypse. The sheer scope of Girard's historical vision is also, admittedly, one ofthe more controversial aspects of his theory. As early as Violence and the Sacred (French, 1972; English trans., 1977), in a conscious revolt against the anti-Hegelian and anti-systematic temper of the times, Girard implied a historical telos for human culture that consists ofthe gradual replacement of sacrificial by non-sacrificial paradigms and praxes. With the publication of Things Hidden Since the Foundation ofthe World (1978; 1987) and The Scapegoat (1982; 1986), however, Girard appeared to step beyond the pale of polite (read, secularist) academic discourse by explicitly identifying the Christian Paraclete as the divine dynamo behind the historical process: "The Spirit is working in history to reveal what Jesus has already revealed, the mechanism ofthe scapegoat, the genesis of all mythology, the nonexistence of all gods of violence" (Scapegoat 207). More recently, in an essay on Satan (literally, "the accuser"), the contrasting role of the Paraclete (literally, "the lawyer for the defense") as a defender ofvictims is again emphasized: Matthew Kratter31 It is possible to read the history, first of the Christianized West, then ofthe Westernized planet, our modern history, as... a process of vindication and rehabilitation of more and more persecuted victims. New hidden victims of society are continuously being brought to light; the consensus against them always dissolves after a while. First it was slaves, then the lower classes, then people ofdifferent ethnic and religious backgrounds. Today the victimization of ethnic groups, of women, ofhandicapped people, ofthe very young and the very old, is coming to light. (GirardReader 208) Mostrecently, Girard's view ofhistory has become, ifanything, more unified, as (following Raymund Schwager) he has begun to emphasize the continuity between the sacrificial and the non-sacrificial (without, of course, trying to elide their differences). At a recent AAR/SBL conference in San Francisco (22 November 1997), Girard discussed the Eucharist as a recapitulation ofthe religious history of mankind, in which all previous forms of sacrifice are present (from cannibalism and "other-sacrifice" to the other end of the spectrum and "self-sacrifice"). Or phrased somewhat differently, the redemptive effects ofthe Passion radiate backwards and forwards in time— what Giuseppe Fornari implies when he refers to Christianity's "capacity to redeem the whole history ofman, summing up and surpassing all its sacrificial forms" (187). It may well prove that "Sacrifice" (with a capital "S") is the single most important and comprehensive word that we possess to describe our history. The central contention ofthis essay is that the phenomenon ofthe vampire offers itself as a privileged site for exploring this work of the Paraclete in history. The very processes of "bringing to light" and "exhuming victims," described by Girard above, are certainly metaphors appropriate to the twilit world ofthe vampire, in which the undead are always being dug up or exposed to die light. IfI maintain that, this late in the twentieth century, we are living in the "twilight ofthe vampires," the allusion to Wagner's Götterdämmerung and Nietzsche's Götzen-dämmerung is not accidental. The ambiguity ofthe German verb dämmern (which can mean "to grow dark" or "to grow light") captures all the paradoxes that surround the mythologizing, demythologizing, and remythologizing of the traditional figure ofthe vampire. I will explore these paradoxes in five successive moments (in the most archaic and traditional form taken by the vampire, then in a medieval persecution text, a late-Victorian novel, a German Expressionist film, and finally a series of 32Twilight ofthe Vampires contemporary popular novels) in order to demonstrate the various metamorphoses undergone by the vampire throughout a history which may be viewed as overseen by the Paraclete—and by a... Consequentialist and Kantian theories differ over the ethical relevance of consequences of actions. I investigate how they might differ too over the relevance of what actions are consequence of. Focusing on the case of group action and collective responsibility, I argue that there's a kind of analog to the problem of aggregating the value of consequencesthat Kantian theories will not confront and consequentialist theories will. The issue provides a useful way to characterize a deep difference between Kantian and consequentialist theories (...) and points, ironically, toward a way of making those views compatible. (shrink)

What is the ontological status of temporal becoming, of the present, or the now? We shall consider in turn four answers to this question: (i) the objective-property doctrine, (ii) the thought-reflexive analysis, (iii) the tensed-exemplification view, and (iv) the form-of-thought account.

According to nomological accounts of causation causal connections among events or states must be mediated by contingent laws of nature. Three types of causal connection are cited and discussed in opposition to such nomological accounts: (a) material causation (as when a zygote is generated by the union of an ovum and a sperm); (b) consequentialist causation (as when an apple is chromatically colored as a result of being red); (c) inclusive causation (as when a board is on a stump in (...) consequence of its having been placed there by a carpenter). These are all source-consequence relations or result-yielding relations and they are all cases of necessitation, each with its own distinguishing features. (shrink)

Truth centered epistemology puts truth at the center in more ways than one. For one thing, it makes truth a main cognitive goal of inquiry. For another, it explains other main epistemic concepts in terms of truth. Knowledge itself, for example, is explained as belief that meets certain other conditions, among them being true. And a belief is said to be rationally or epistemically justified or apt, which it must be in order to be knowledge, only if it derives from (...) a truth-conducive faculty, an intellectual virtue. What defensible theories of truth are open to such truth-centered epistemology? That is our main question. (shrink)

What is involved in acquiring a russellian proposition (x, φ) as content of an attitude: what does it take for one to acquire such an attitude de re? How do we gain access to x itself so as to be able to have (x, φ) as content of our thought?

Given the constraints, however, I must be selective in my response. First of all, I will aim to present my view of human knowledge in a broader context. Against this background I will then respond to several of the points they have made.
